High Court throws out application to prohibit Deputy IGP from performing duties

The High Court in Accra has dismissed an application by a lecturer seeking to prohibit COP Christian Tetteh Yohuno from performing his role as Deputy Inspector General of Police in charge of operations.

Emmanuel Felix Amantey had alleged that the police council and the presidency acted in excess of their powers when the two offices appointed a deputy inspector general of police incharge of operations.

According to him, not only is the constitution and the Ghana Police Service ACT silent on such a role, the only legal document that anticipates such an office the police service regulation, is does not make room for a deputy in charge of operations.

He thus filed the judicial review application accusing the president and the police council of perpetrating an illegality.

The High Court in Accra has dismissed an application by a lecturer seeking to prohibit COP Christian Tetteh Yohuno from performing his role as Deputy Inspector General of Police in charge of operations.

He thus filed the judicial review application accusing the president and the police council of perpetrating an illegality.

But Justice Richard Apietu in delivering his ruling on the matter indicated that the supervisory jurisdiction of the High court was not properly invoked.

He explained that while such powers of the court are concerned with adjudicatory functions exercised by lower adjudicating bodies, the President and the Police Council are not lower adjudicating bodies.

Justice further argued that, the President and the Police Council were exercising administrative powers.

He thus dismissed the application.
